By visiting the website at buckeyeasphaltpaving.com, requesting a service estimate, or engaging Buckeye Asphalt Paving ("Company," "we," "us," or "our") to perform work, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our website or services. These terms apply to all visitors, customers, and anyone else who accesses our website or requests our services.
Buckeye Asphalt Paving provides asphalt paving, sealcoating, repair, striping, and related pavement services to residential and commercial customers in Buckeye, AZ and surrounding communities. The specific scope of work for any project is defined in a written estimate or contract provided before work begins. Any work outside the written scope is subject to a separate written agreement and additional charges.
Estimates are provided at no charge and with no obligation. All estimates are based on a site visit and the conditions observed at the time of assessment. Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.
Final pricing is set in the written estimate or contract you receive before work begins. If conditions change significantly between the estimate and the start of work - due to changes in material costs, site conditions, or project scope - we will notify you in writing before proceeding with any additional charges.
Verbal pricing discussions are not binding. Only written estimates and signed contracts constitute a pricing commitment.
Work is scheduled following your acceptance of a written estimate or execution of a contract. We will provide you with a scheduled start date. Start dates are subject to change due to weather conditions, equipment availability, or other factors outside our control. We will notify you as soon as possible of any scheduling changes.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before a scheduled start may be subject to a cancellation fee to cover mobilization costs incurred, as specified in your written contract.
We reserve the right to delay or reschedule work due to weather conditions that would affect work quality, including extreme heat, rain, or other conditions inconsistent with proper asphalt installation or sealing. No additional charges apply for weather-related rescheduling.
Payment terms are specified in your written estimate or contract. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, we may require a deposit before work begins, with the remaining balance due upon completion. Specific deposit amounts and payment schedules will be stated in your written agreement.
Accepted payment methods will be communicated to you before work begins. Invoices not paid within the timeframe specified in your contract may be subject to late fees as described in that agreement.
In the event of non-payment, we reserve the right to pursue all remedies available under Arizona law, including filing a mechanic's lien on the property where work was performed, where applicable.

Where a workmanship warranty is provided, it will be stated in your written estimate or contract, including its duration and coverage. Any warranty applies only to defects in workmanship and materials directly attributable to our work, under normal use and conditions.
Warranty coverage does not apply to damage caused by factors outside our control, including but not limited to: acts of nature, extreme weather events, failure to follow post-installation care instructions, vehicle damage, ground movement or subsidence not caused by our work, or modifications made to the work by anyone other than Buckeye Asphalt Paving.
To make a warranty claim, contact us in writing within the warranty period. We will assess the issue and determine whether it falls within warranty coverage before scheduling any remediation work.
To the maximum extent permitted by Arizona law, Buckeye Asphalt Paving's total liability for any claim arising from our services or website shall not exceed the total amount you paid us for the specific project giving rise to the claim.
We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services or website, including but not limited to lost profits, loss of use, or business interruption, even if we have been advised of the possibility of such damages.
Our website and its content are provided "as is" without warranty of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Information on our website is for general informational purposes only and does not constitute a binding offer or guarantee of specific results. We want to resolve any issues directly and in good faith. If you have a concern about work performed or a billing matter, please contact us first at the information below so we have the opportunity to address it.
If a dispute cannot be resolved through direct communication, the parties agree to attempt resolution through mediation before initiating any formal legal proceedings. The cost of mediation will be split equally between the parties unless otherwise agreed in writing.
Any unresolved disputes shall be subject to binding arbitration conducted in Maricopa County, Arizona, under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
We may update these Terms and Conditions at any time. When we do, we will revise the effective date at the top of the page. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically. For significant changes affecting active projects, we will notify you directly in writing.
